Under Lincoln, Neb., Mun. Code ch. 21.56 § 21.56.190, any individual, firm, or corporation that violates the provisions of Chapter 21.56 may face criminal misdemeanor charges. Upon conviction, a violator may face up to six months in county jail, a fine of up to $500 (plus costs), or both, with mandatory minimum fines starting at $200 for a first offense, $250 for a second, and $300 for a third or subsequent offense.
Plain English — not legal advice.
Property owners and managers operating under Lincoln's Chapter 21.56 should be aware that § 21.56.190 establishes escalating criminal penalties for each day a violation persists. Compliant operators generally conduct regular inspections and promptly address any code deficiencies to avoid the accumulation of separate daily offenses. Because fines increase with each subsequent conviction, maintaining ongoing compliance is a standard practice among responsible operators in Lincoln.

Section 21.56.190 of Lincoln's Municipal Code establishes that violations of Chapter 21.56 carry criminal misdemeanor consequences for those responsible, which can be relevant context when a tenant believes a landlord is maintaining an ongoing code violation. Tenants who believe their housing conditions involve a continuing violation may consider documenting the issue over time, since each day of violation constitutes a separate offense under this provision. Reaching out to Lincoln's local code enforcement office or a tenant-rights organization can help tenants understand what reporting or complaint options may be available to them.
