Under Omaha, Neb., Code of Ordinances ch. 13, art. IV § 13-365, when the director of the relevant city office finds reasonable cause to believe a discriminatory housing practice has occurred or is about to occur, a formal charge must be issued on behalf of the affected person. That charge must include a clear, concise statement of the facts supporting the reasonable-cause finding and must be grounded in the final investigative report. Notably, the charge is not confined to only the facts or legal grounds raised in the original complaint, meaning the investigation may surface additional relevant findings.

For Property Managers

Property owners and managers subject to a fair housing investigation in Omaha should be aware that under § 13-365 of Omaha, Neb., Code of Ordinances ch. 13, art. IV, a formal charge can be issued based on the director's final investigative report and may go beyond the scope of the original complaint. Compliant operators generally maintain thorough, contemporaneous records of all housing decisions—such as application reviews, lease denials, and maintenance responses—so that any factual inquiry can be addressed accurately. Understanding that a charge under this provision triggers further proceedings under § 13-369 underscores the importance of consistent, documented fair-housing practices.

For Tenants

If you believe you have experienced discriminatory housing treatment in Omaha, Omaha, Neb., Code of Ordinances ch. 13, art. IV § 13-365 describes how the director can issue a formal charge on your behalf once reasonable cause is found through investigation. The charge is drawn from the final investigative report and is not limited to the specific facts you raised in your initial complaint, which means the process may capture a broader picture of the alleged discrimination. Tenants can explore filing a complaint under § 13-351 to initiate this process, and consulting a local tenant-rights organization or fair-housing agency can help clarify what options are generally available.
