Operative Text
This chapter shall not apply to: 1. A religious organization, association, or society or any nonprofit institution or organization operating, supervised, or controlled by or in conjunction with a religious organization, association, or society, "which it owns or operates for other than commercial purpose" to persons of the same religion, or which gives preference to such persons, unless membership in such a religion is restricted on account of race, color, sex, or national origin. 2. A private club not in fact open to the public, which as an incident to its primary purpose or purposes, provides lodgings which it owns or operates for other than a commercial purpose, and which limits the rental or occupancy of such lodgings to its members or gives preference to its members. 3. Any single-family house sold or rented by an owner; provided, that such private individual owner does not own more than three (3) such single-family houses at any one time; provided further, that in the case of the sale of any such single-family house by a private individual owner not residing in such house at the time of such sale or who was not residing in such house at the time of such sale or who was not the most recent resident of such house prior to such sale, the exemption granted by this section shall apply only with respect to one such sale within any twenty-four (24) month period; provided further that such bona fide private individual owner does not own any interest in, nor is there owned or served on this behalf, under any express or voluntary agreement, title to or any right to all or a portion of the proceeds from the sale or rental of, more than three (3) such single-family houses at one time; provided further, the sale or rental of any such single-family house shall be excepted from the application of this chapter only if such house is sold or rented: a. Without the use in any manner of the sales or rental facilities or the sales or rental services of any real estate broker, agent, or salesman, or of any employee or agent of any such broker, agent, salesman, or person, and b. Without the publication, posting or mailing, after notice, of any advertisement or written notice in violation of the provisions of 42 United States Code Section 360.4(c) or of Section 9.12.030 of this chapter; but nothing in this provision shall prohibit the use of attorneys, escrow agents, abstractors, title companies, and other such professional assistance as necessary to perfect or transfer the title; or 4. Rooms or units in dwellings containing living quarters occupied or intended to be occupied by no more than four (4) families living independently of each other, if the owner actually maintains and occupies one (1) of such living quarters as his residence.
Carson City Municipal Code § 9.12.040 carves out several categories of housing from the fair-housing and anti-discrimination rules established in Chapter 9.12. Specifically, the provision exempts religious organizations renting to their own members, private clubs providing lodging only to members, small-scale individual owners renting or selling single-family homes under defined conditions, and owner-occupied buildings with four or fewer units. These exemptions are narrow and come with specific qualifying conditions—such as limits on how many properties an individual owner may hold and restrictions on using real estate professionals in the transaction.
Plain English — not legal advice.
Property owners and operators who believe they fall within one of the § 9.12.040 exemptions should carefully review each condition before relying on an exemption. For example, a private individual claiming the single-family home exemption under § 9.12.040(3) must generally own no more than three such homes, avoid using real estate brokers or agents in the transaction, and refrain from publishing any discriminatory advertisement. Operators of owner-occupied small multi-family buildings (four units or fewer) under § 9.12.040(4) must actually reside in one of the units to qualify, meaning the exemption does not extend to absentee owners.

Tenants who believe they have experienced discriminatory treatment in housing should be aware that § 9.12.040 lists specific, limited exemptions to Carson City's fair-housing protections—and that a landlord's claim of exemption may not always hold up if the qualifying conditions are not fully met. Tenants can review whether a landlord actually satisfies all the stated criteria, such as ownership limits or owner-occupancy requirements, before concluding that Chapter 9.12 does not apply to their situation. General enforcement paths may include filing a complaint with a local or state civil rights body, raising the inapplicability of an exemption as a defense in a housing proceeding, or consulting a tenant-rights organization familiar with Nevada fair-housing law.
