Albany, N.Y., Code of Ordinances ch. 231 § 231-118
Removal of posted notice
Operative Text
No person shall deface or remove the posted notice from any dwelling, dwelling unit, lodging house, lodging unit, rooming house or rooming unit which has been designated as unfit for human habitation, except as provided in § 231-117 .
Albany, N.Y., Code of Ordinances ch. 231 § 231-118 establishes that once a dwelling, dwelling unit, lodging house, lodging unit, rooming house, or rooming unit has been officially designated as unfit for human habitation, the posted notice marking that status is legally protected. No individual—regardless of their role—may deface or remove that notice, unless the removal is carried out under the specific conditions authorized by § 231-117. The rule preserves the integrity of the public notice system so that occupants, visitors, and inspectors can rely on posted designations as accurate indicators of a property's official status.
Plain English — not legal advice.
Property owners and managers operating under Albany, N.Y., Code of Ordinances ch. 231 § 231-118 generally ensure that any notice designating a property as unfit for human habitation remains fully intact and visible for as long as the designation is in effect. Compliant operators do not remove, cover, or damage such notices themselves, and they take reasonable steps to prevent others from doing so on properties they control. Authorized removal, as outlined in the companion provision § 231-117, is the only recognized pathway for lawfully taking down such a notice.

Under Albany, N.Y., Code of Ordinances ch. 231 § 231-118, tenants have an interest in knowing that a posted unfit-for-habitation notice on their building or unit cannot lawfully be removed or defaced by anyone outside the process described in § 231-117. If a tenant observes that such a notice has been tampered with or removed without apparent authorization, they may report the situation to the relevant Albany code enforcement or housing authority. Tenant-rights organizations in the Albany area can help residents understand what a posted designation means for their housing situation and what general options may be available to them.
