Albany, N.Y., Code of Ordinances ch. 231 § 231-139 establishes a local prohibition on eviction without good cause, adopted under New York State Real Property Law Article 6-A. The rule carves out an exemption for rental units whose monthly rent exceeds 345% of the HUD-published fair market rent for Albany County, as further published by the New York State Division of Housing and Community Renewal. It also defines a 'small landlord' narrowly—as someone who owns no more than one rental unit anywhere in New York State—for purposes of how the article applies.
Plain English — not legal advice.
Under Albany, N.Y., Code of Ordinances ch. 231 § 231-139, compliant operators generally determine whether each unit's monthly rent exceeds 345% of the applicable HUD fair market rent figure for Albany County, since units above that threshold are exempt from the good-cause eviction protections. Landlords who own more than one rental unit anywhere in New York State do not qualify as a 'small landlord' under this provision and should account for the full scope of the article's requirements. Keeping current records of unit rents and monitoring the annually updated fair market rent figures published by HUD and the New York State Division of Housing and Community Renewal is a practice consistent with compliance.

Albany, N.Y., Code of Ordinances ch. 231 § 231-139 gives tenants in qualifying units a foundational protection against eviction without good cause. Tenants whose monthly rent is at or below 345% of the HUD-published fair market rent for Albany County may be covered by these protections, and a landlord's failure to establish good cause for eviction could be raised as a defense in a proceeding. Tenants seeking to understand whether their unit qualifies—or how to respond to an eviction notice—may find it useful to consult a local tenant-rights organization or review the fair market rent figures published by the New York State Division of Housing and Community Renewal.
