Albany, N.Y., Code of Ordinances ch. 231 § 231-73 requires that every dwelling unit be equipped with functioning cooking and refrigeration equipment. Responsibility for supplying that equipment falls on the owner by default, though a written agreement between owner and tenant may shift that obligation to the tenant. Gas-burning cooking appliances must be permanently installed and connected via approved piping or flexible tubing, and solid fuel-burning cooking equipment must be properly vented to the outside.

Under Albany, N.Y., Code of Ordinances ch. 231 § 231-73, compliant property operators ensure that each rental unit contains working cooking and refrigeration equipment at all times. If a landlord intends for a tenant to supply their own appliances, that arrangement must be documented in a mutual written agreement — a verbal understanding is not sufficient. Operators also verify that any gas-burning cooking equipment is permanently connected using code-approved pipe or flexible tubing connectors, and that solid fuel-burning units are properly vented, consistent with the definitions set out in § 231-10.

Albany, N.Y., Code of Ordinances ch. 231 § 231-73 gives tenants a right to a dwelling unit equipped with cooking and refrigeration equipment that is maintained in good operating condition. Unless a written agreement signed by both parties places the responsibility on the tenant, the owner is obligated to provide that equipment. Tenants who believe this requirement is not being met may consider contacting Albany's code enforcement office, raising the violation in any relevant housing proceeding, or reaching out to a local tenant-rights organization for guidance on available options.
