Auburn, N.Y., Code of Ordinances ch. 182 § 182-52
Applicability
Operative Text
A. This Part 2 shall apply to the provisions and to premises within the scope of Part 1 . B. Notwithstanding any of the requirements of Part 1 , for premises, buildings, or structures which do not conform thereto, in whole or in part, on the effective date and which require substantial alterations or installations to satisfy any such requirements, although in violation thereof, the Housing Code Inspector may grant a reasonable period of time, up to one year after the effective date, within which the premises, buildings, or structures are to be made to conform, except if a building or structure is found to be dangerous and unsafe, in which event, prompt compliance with the requirements herein provided shall be undertaken and carried out. Nothing contained herein shall be construed to extend compliance with any or all the provisions of the Uniform Code.
Auburn, N.Y., Code of Ordinances ch. 182 § 182-52 establishes that Part 2 of the Housing Code applies to the same premises and provisions covered by Part 1. Properties that were already out of compliance when the code took effect may be granted a grace period of up to one year to come into conformance, at the discretion of the Housing Code Inspector. However, any property deemed dangerous or unsafe must achieve compliance promptly, and no part of this provision extends deadlines that apply under New York's Uniform Code.
Plain English — not legal advice.
Under § 182-52, property owners whose buildings did not fully meet Part 1 requirements on the code's effective date may be eligible to request a reasonable compliance timeline—up to one year—from the Housing Code Inspector. Compliant operators typically document existing conditions, communicate proactively with the Inspector, and develop a concrete remediation schedule within any granted period. Properties flagged as dangerous or unsafe fall outside this grace-period provision and require immediate corrective action regardless of any other timeline.

Section 182-52 means that even if a landlord was given extra time to bring a property into compliance, that accommodation does not override protections under the Uniform Code, and dangerous or unsafe conditions must be addressed without delay. Tenants who believe their building remains out of compliance after any grace period may raise the violation as a defense in relevant proceedings or file a complaint with the appropriate local housing authority in Auburn. Tenant-rights organizations familiar with Auburn's Housing Code can help residents understand what options are generally available under this provision.
