Auburn, N.Y., Code of Ordinances ch. 182 § 182-70 establishes a broad set of building-maintenance responsibilities that fall on the owner, operator, or agent in control of a property. The rule covers everything from capping occupancy at permitted levels and posting occupancy notices, to keeping plumbing, heating, and electrical systems in working order, maintaining clean common-area surfaces, keeping exits unobstructed, disposing of garbage properly, and exterminating pests. The provision places these duties squarely on the controlling party rather than on occupants, making the building's responsible party the primary accountable actor for habitability and safety conditions.
Plain English — not legal advice.
Under Auburn, N.Y., Code of Ordinances ch. 182 § 182-70, compliant property operators generally maintain written records of permitted occupancy limits and post required notices in visible locations. They conduct routine inspections of plumbing, heating, electrical systems, and common areas to catch maintenance deficiencies early, and they arrange timely pest-control services when evidence of infestation appears. Operators also establish regular garbage-removal schedules and verify that all exits remain clear and accessible at all times.

Auburn, N.Y., Code of Ordinances ch. 182 § 182-70 gives tenants a basis for expecting that their building's owner, operator, or agent will maintain safe, sanitary, and functional conditions—including working utilities, pest-free premises, clean common areas, and unobstructed exits. If these conditions are not being met, tenants may consider documenting the deficiencies in writing and notifying the property's responsible party, or contacting the Auburn Code Enforcement office to request an inspection. Tenant-rights organizations can help residents understand what options are generally available when a landlord appears to be falling short of the obligations this section describes.
