Plain English

Auburn, N.Y., Code of Ordinances ch. 182 § 182-71 establishes that occupants bear responsibility for the condition and use of the portions of a building they occupy, control, or use. This includes keeping those areas clean, safe, and sanitary; using the space only for its lawfully permitted purpose; maintaining plumbing, cooking, and refrigeration equipment properly; keeping exits clear; disposing of garbage and refuse in provided facilities; and managing domestic animals and pets appropriately. The rule places these obligations directly on the occupant rather than the property owner for the areas under the occupant's control.

For Property Managers

Under Auburn, N.Y., Code of Ordinances ch. 182 § 182-71, compliant property operators typically document occupancy limits and permitted uses in lease agreements and communicate them clearly to residents at move-in. Operators generally ensure that garbage disposal facilities are provided and that lease terms reinforce occupants' obligations regarding sanitation, exit clearance, and pet management. Keeping records of unit condition at move-in and conducting periodic inspections can help demonstrate that any code issues arising in an occupied unit stem from occupant responsibility rather than owner neglect.

For Tenants

Auburn, N.Y., Code of Ordinances ch. 182 § 182-71 outlines the responsibilities that fall on occupants for the areas they control, including maintaining sanitary conditions, keeping exits clear, properly disposing of refuse, and managing pets appropriately. Tenants who receive notices of violation related to these obligations have the right to review the specific findings and understand which party—owner or occupant—is responsible under the code. Tenants with questions about how these responsibilities interact with their lease terms or local enforcement practices may find it helpful to consult a tenant-rights organization or legal aid service familiar with Auburn housing regulations.
