C. The Nuisance Abatement Committee shall meet on a quarterly basis to hear appeals, at which time the aggrieved party or their counsel shall be granted the opportunity to present arguments on his or her own behalf to the Nuisance Abatement Committee. D. Pursuant to the City Code of Auburn § 213-5 , the Nuisance Abatement Committee shall possess the authority to make a determination as to reverse, modify, or affirm the final order or administratively imposed fee of the Housing Code Inspector. E. Any person or persons jointly or severally aggrieved by any final order of the Nuisance Abatement Committee shall be deemed as exhausting all available administrative remedies and may seek to have such order reviewed by the Supreme Court in the manner prescribed by Article 78 of the Civil Practice Law and Rules and as otherwise provided for in the laws of the State of New York.
Auburn, N.Y., Code of Ordinances ch. 182 § 182-75 establishes a two-stage review process for challenging decisions made by the Housing Code Inspector. First, an aggrieved party may appeal a final order or administrative fee to the Nuisance Abatement Committee by submitting a written request within 14 days of receiving the order or fee notice. If the Nuisance Abatement Committee's decision is still unsatisfactory, the party is considered to have exhausted administrative remedies and may then seek judicial review through New York's Article 78 proceeding in Supreme Court.
Plain English — not legal advice.
Under § 182-75, property owners who receive a final order or administrative fee from the Housing Code Inspector have a defined window—14 days from receipt—to initiate an appeal by submitting a written request and a copy of the challenged order or fee notice to the Office of the City Manager. Compliant operators generally keep careful records of all inspection notices and their receipt dates to preserve appeal rights before the Nuisance Abatement Committee. If the Committee's ruling remains adverse, operators are aware that the next available avenue is an Article 78 proceeding in New York Supreme Court, which carries its own procedural requirements.

Section 182-75 of Auburn's Code of Ordinances gives any person aggrieved by a Housing Code Inspector's order or fee the right to request an administrative review before the Nuisance Abatement Committee, provided a written request is filed within 14 days of receiving the notice. Tenants who believe an order or fee affects their housing situation may present arguments—personally or through counsel—at the Committee's quarterly hearings. If the Committee's final decision remains unfavorable, that decision may be challenged in New York Supreme Court through an Article 78 proceeding; tenant-rights organizations or legal aid services can help explain what that process generally involves.
