Batavia, N.Y., Code of Ordinances ch. 143 § 143-4
Applicability
Operative Text
A. In order to protect the public health, welfare and safety of the community, no person shall operate a rooming house within the City of Batavia without obtaining a permit issued by the Code Enforcement Officer upon the approval of the Planning and Development Committee. Such permit may be issued, provided that the procedures and standards of this chapter have been complied with. B. This chapter shall apply to existing buildings and dwelling houses that have already received a permit to operate a rooming house prior to July 1, 2015. No new permits shall be issued by the Planning and Development Committee following July 1, 2015, other than renewal permits as outlined in § 143-5 of this chapter. C. All provisions of the City of Batavia Municipal Code shall apply to the provisions of this chapter, except where exemptions are specifically authorized by this chapter.
Section 143-4 of Batavia's Code of Ordinances establishes that operating a rooming house within the City of Batavia requires a permit issued by the Code Enforcement Officer with Planning and Development Committee approval. As of July 1, 2015, no new rooming house permits may be issued — only renewal permits for operations that were already permitted before that date remain available. The broader Batavia Municipal Code applies to all rooming house operations under this chapter unless a specific exemption is granted within the chapter itself.
Plain English — not legal advice.
Under § 143-4, rooming house operators in Batavia must hold a valid permit issued through the Code Enforcement Officer and approved by the Planning and Development Committee. Because no new permits have been available since July 1, 2015, compliant operators are those who obtained their permit before that date and have maintained it through the renewal process described in § 143-5. Operators generally ensure their properties remain in full compliance with the City of Batavia Municipal Code, as all municipal code provisions apply to rooming houses regulated under this chapter.

Section 143-4 means that any rooming house legally operating in Batavia should hold a permit that predates July 1, 2015, and has been kept current through renewals under § 143-5. Tenants who have questions about whether their rooming house is properly permitted may inquire with the City of Batavia's Code Enforcement Officer, who is the issuing authority under this provision. Tenant-rights organizations familiar with Batavia housing law can help residents understand what options may be available if a rooming house appears to be operating without the required permit.
