Plain English

Section 173-12 of Beacon, N.Y., Code of Ordinances ch. 173 establishes the official methods by which the city may deliver a notice of violation to a landlord, owner, or managing agent when a rental housing rule is allegedly broken. Valid delivery methods include in-person hand-off, registered or certified mail to the address on file in the landlord registration statement or the City Assessor's records, conspicuous posting on the property when other methods fail, and any service method permitted under New York Civil Practice Law and Rules. A notice served by any of these methods carries the same legal weight as personal service on all relevant parties.

For Property Managers

Under § 173-12, keeping an accurate, current address on file in the landlord registration statement is a practical cornerstone of compliance, because that address is the first place the city will send a certified or registered mail notice of violation. Compliant operators also ensure their managing agent's contact information is up to date, since the provision specifically names managing agents as recipients. When an address is missing or outdated, the city may fall back on Assessor's Office records or even property posting, which can result in a notice being legally effective even if the owner never physically receives it.

For Tenants

Section 173-12 governs how the city formally notifies landlords and managing agents of violations of Beacon's rental housing article, which is relevant context for tenants who have reported a housing condition or code issue. When a violation notice has been properly served under this provision—whether by mail, in person, or by posting—the landlord is legally on notice regardless of whether they claim they never received it. Tenants who want to understand whether a violation has been formally issued may consult Beacon's code enforcement office or a local tenant-rights organization for guidance on how to track the status of a complaint.
