Plain English

Section 154-24 of Buffalo's Code of Ordinances, Chapter 154, Article IV establishes a severability rule for the article's rent-related provisions. Under this rule, if a court with proper authority declares any single part of the article legally invalid, that ruling applies only to the invalidated portion. The rest of the article's provisions remain in full force and effect, unaffected by the court's judgment.

For Property Managers

As a property owner or manager operating under Buffalo's Chapter 154, Article IV, it is useful to understand that Section 154-24 protects the overall regulatory framework from being undone by a challenge to any one provision. Compliant operators generally continue to follow all other requirements of the article even if a specific section is struck down by a court. This means that obligations under the remaining portions of Article IV stay in place regardless of any partial legal ruling.

For Tenants

Section 154-24 of Buffalo's Code of Ordinances, Chapter 154, Article IV means that tenants' rights and protections established elsewhere in the article are not automatically eliminated if one part of the article is found invalid by a court. Tenants can generally continue to rely on the surviving provisions of Article IV when raising concerns or seeking remedies. Tenant-rights organizations in Buffalo can help clarify which specific provisions remain in effect following any court ruling.
