Conditions (Buffalo Rental Dwelling Unit Registration Ordinance)
Operative Text
A. Owners seeking to obtain a certificate of rental compliance for dwelling units subject to this chapter must meet the following conditions: (1) Complete the rental dwelling unit certificate application and disclose all required information to the satisfaction of the Department of Permit and Inspection Services. (2) Complete an Affidavit of Compliance pursuant to § 264-24 . (3) At the time of application, the property may not be subject to an active nuisance proceeding or be subject to any existing Order to Vacate or Do Not Occupy Order issued by the City Department of Permit and Inspection Services or the Erie County Department of Health. (4) The dwelling unit must pass an exterior and interior rental unit inspection conducted by the Department to ensure that the dwelling unit has no active housing code violations that threaten the life, health or safety of current or future occupants of the unit as determined by the Commissioner.
Buffalo City Code Chapter 264, Section 264-22 establishes the conditions that must be satisfied before a rental dwelling unit can receive a certificate of rental compliance. To qualify, the property must have a completed application with full disclosures, a signed Affidavit of Compliance, no active nuisance proceedings or outstanding vacate orders from the city or Erie County, and must pass both an exterior and interior inspection confirming no housing code violations that threaten occupant life, health, or safety. The Department of Permit and Inspection Services administers and evaluates each of these requirements.

Under Buffalo Code § 264-22, compliant rental property operators generally ensure their application package is complete and fully disclosed to the Department of Permit and Inspection Services before submission. They also confirm that no active nuisance proceedings, Orders to Vacate, or Do Not Occupy Orders are outstanding against the property at the time of application, and that the unit is free of housing code violations that could endanger occupants. Scheduling and passing both the exterior and interior inspections required by § 264-22 is a standard part of the compliance process for operators maintaining rental properties in Buffalo.

Buffalo Code § 264-22 establishes that rental units must meet specific health and safety standards—including passing an inspection for code violations—before a landlord can legally obtain a certificate of rental compliance. Tenants who believe their unit has not met these conditions, or that a certificate was obtained despite active violations or outstanding orders, may contact the Buffalo Department of Permit and Inspection Services to inquire about the unit's compliance status. Tenant-rights organizations in the Buffalo area can also help residents understand how § 264-22 applies to their housing situation and what general options exist for raising concerns.
