Section 748-23 of Canandaigua's Code of Ordinances establishes that owners or their designated operators bear responsibility for meeting the city's minimum housing standards across a defined set of conditions in lodging houses. These responsibilities cover occupancy limits, sanitation of walls, floors, ceilings, and common areas, proper functioning of plumbing and appliances, pest control, clear exits, and garbage disposal. The rule also assigns responsibility for installing and removing required window screens and maintaining all supplied facilities in working order.
Plain English — not legal advice.
Under § 748-23, compliant lodging house operators generally keep occupancy within permitted limits, maintain all plumbing, cooking, and refrigeration equipment in clean and operative condition, and ensure exits remain clear at all times. Routine pest control, sanitary garbage disposal, and timely installation or removal of required screens are also part of the standard compliance picture under this section. Operators who have designated a manager or agent to oversee the property should ensure that person is fully aware of these obligations, since the code holds both owners and their designees accountable.

Section 748-23 places the burden of maintaining safe, sanitary, and properly equipped lodging house premises squarely on the owner or their designated operator, not on tenants. If conditions such as pest infestations, blocked exits, broken plumbing, or unsanitary common areas are present, tenants may have grounds to raise a violation of this provision when communicating with the owner or when contacting the appropriate Canandaigua code enforcement office. Tenant-rights organizations familiar with New York housing law can help residents understand what documentation to gather and what local complaint processes may be available under ch. 748.
