Canandaigua, N.Y., Code of Ordinances ch. 748 § 748-24
Responsibilities of occupants
Operative Text
Occupants of all dwelling units shall be responsible for compliance with the minimum housing standards in regard to the following: A. Limiting occupancy to that part of the premises which he occupies or controls to the maximum permitted by the minimum housing standards. (1) Maintenance of that part of the premises which he occupied or controls in a clean, sanitary and safe condition. (2) Maintenance of all plumbing, cooking, and refrigeration fixtures and appliances, as well as other building equipment and storage facilities in that part of the premises which he occupies or controls, in a clean and sanitary condition, and providing reasonable care in the operation and use thereof. (3) Keeping exits from his dwelling unit and fire escapes and stairs clear and unencumbered. (4) Disposal of garbage and refuse into provided facilities in clean and sanitary manner. (5) If a rental dwelling unit, not removing or damaging safety equipment. (6) If a rental dwelling unit, not permitting grease or other flammable material to accumulate in or on ranges and drains, nor permitting any other condition to exist which is conducive to fire. Occupants shall be prohibited from accumulating or storing on residential premises, except in approved locations, any highly flammable or explosive matter such as paints, volatile oils, cleaning fluids and similar materials, or any combustible refuse liable to spontaneous combustion such as waste paper, boxes, rags or similar materials.
Section 748-24 of Canandaigua's Code of Ordinances places a set of minimum housing standard responsibilities directly on the people who live in dwelling units, rather than solely on landlords or property owners. Occupants are required to keep their portion of the premises clean, safe, and sanitary — including plumbing, cooking, and refrigeration fixtures — and to keep exits, fire escapes, and stairs clear at all times. The provision also prohibits tenants in rental units from removing safety equipment, allowing grease or flammable materials to accumulate, or storing highly flammable or explosive substances (such as volatile oils, paints, or cleaning fluids) anywhere on the residential premises except in approved locations.
Plain English — not legal advice.
Under § 748-24, property owners and managers should be aware that certain minimum housing standard obligations run directly to occupants, not just to the landlord. Compliant operators typically document the condition of safety equipment, exits, and appliances at move-in and move-out, and include lease language that mirrors the occupant responsibilities outlined in § 748-24 — such as prohibitions on storing flammable materials in unapproved locations. Keeping records of inspections and any notices provided to tenants about these standards supports a clear compliance posture under Canandaigua's Code of Ordinances ch. 748.

Section 748-24 of Canandaigua's Code of Ordinances makes clear that occupants share responsibility for maintaining their portion of a dwelling in a clean, safe, and sanitary condition, and that certain fire-safety obligations — like not storing flammable materials in unapproved areas or allowing grease to accumulate — fall directly on the tenant. Tenants who believe a landlord's actions (or inactions) are contributing to housing standard violations may have grounds to raise those issues with the local code enforcement authority in Canandaigua. Tenant-rights organizations can help occupants understand how § 748-24 interacts with any landlord obligations that may apply to their situation.
