Section 748-25 of Canandaigua's Code of Ordinances establishes liability protections for city personnel who carry out duties under Chapter 748. City officers, agents, and employees cannot be held personally responsible for damages arising from actions they are required or permitted to take under the chapter. Additionally, any city officer who conducts inspections must be bonded at the city's expense, and unbonded officers are prohibited from performing inspections.
Plain English — not legal advice.
Under § 748-25, landlords and property managers interacting with city inspectors should be aware that those inspectors are acting under a framework that shields them from personal liability for authorized acts. Compliant operators generally verify that any inspector who enters their property is a duly authorized city representative, which the bonding requirement helps ensure. Understanding this structure can inform how operators respond to inspection-related communications and proceedings.

Section 748-25 provides tenants with context about the legal framework governing city inspectors who visit rental properties under Chapter 748. The bonding requirement means that any inspector conducting an inspection must be bonded at city expense — an unbonded officer is not permitted to inspect. Tenants who have questions about whether an inspection was conducted by a properly authorized and bonded officer may wish to contact the city directly or consult a tenant-rights organization familiar with Canandaigua's housing code.
