Cohoes, N.Y., Code of Ordinances ch. 148 § 148-12
Amendment; construal of provisions
Operative Text
A. Amendment. The Common Council of the City of Cohoes may, on its own initiative or on petition, amend, supplement or repeal the provisions of this article in conformity with applicable law after public notice and hearing. B. Interpretation. In their interpretation and application, the provisions of this article shall be held to be minimum requirements, adopted for the promotion of the public health, morals, safety or the general welfare. Whenever the requirements of this article are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the most restrictive or that imposing the highest standards shall govern.
Section 148-12 of Cohoes, N.Y., Code of Ordinances ch. 148 establishes two foundational rules about how the city's rental housing article operates. First, the Common Council retains authority to change, expand, or eliminate the article's provisions through a public notice and hearing process. Second, the article's requirements are treated as a floor, not a ceiling — when this article conflicts with another set of rules or regulations, whichever standard is stricter or more demanding takes precedence.

Under § 148-12, property owners and managers in Cohoes should be aware that the requirements in ch. 148 represent minimum standards, meaning other applicable rules — local, state, or otherwise — may impose additional obligations that also apply. Compliant operators generally monitor for changes to the article, since the Common Council can amend or repeal its provisions following public notice and a hearing. When multiple overlapping regulations apply to a property, operators typically apply whichever rule sets the highest standard.

Section 148-12 makes clear that the protections in Cohoes ch. 148 are minimums, so tenants may be entitled to the benefit of any stricter rule that also applies to their housing situation. If a landlord appears to be complying with ch. 148 but falling short of a more demanding regulation, that gap may be relevant when raising a violation or seeking assistance. Tenants can contact the City of Cohoes directly or reach out to a local tenant-rights organization to understand which set of standards governs their circumstances.
