Elmira, N.Y., Code ch. 8, art. V § 8-405
Fire protection equipment
Operative Text
(a) Fire protection equipment shall be provided in readily accessible locations, and shall be clearly visible, as follows: (1) In boiler or furnace rooms having fuel-burning equipment with a capacity of up to 1,000,000 Btu per hour of individual or combined rating, at least one approved multipurpose dry chemical type portable fire extinguisher; in boiler or furnace rooms with fuel-burning equipment having a capacity in excess of 1,000,000 Btu per hour, at least two such portable fire extinguishers. (2) In dormitory units, one approved class A type portable fire extinguisher for each multiple of 1,250 square feet of floor area, or fraction thereof, in excess of 1,250 square feet of floor area. (3) In central kitchens, one approved multipurpose dry chemical type portable fire extinguisher for each multiple of 1,000 square feet of floor area, or fraction thereof. (4) In public spaces, one approved class A type portable fire extinguisher for each multiple of 2,500 square feet of floor area, or fraction thereof, in excess of 2,500 square feet of floor area. (5) In garages serving multiple dwellings, one approved multipurpose dry chemical portable fire extinguisher for each multiple of 2,500 square feet of floor area or fraction thereof. (b) Where an approved automatic fire extinguishing system is provided, portable fire extinguishers are not required.
Elmira Code ch. 8, art. V § 8-405 establishes specific requirements for portable fire extinguishers in residential and common-area spaces, varying by room type and square footage. Boiler and furnace rooms, dormitory units, central kitchens, public spaces, and garages each have their own extinguisher-count formulas based on heating capacity or floor area. Buildings equipped with an approved automatic fire extinguishing system are exempt from the portable extinguisher requirements entirely.

Under Elmira Code ch. 8, art. V § 8-405, compliant property operators ensure that the correct type and number of portable fire extinguishers are installed in each covered area — boiler rooms, dormitory units, central kitchens, public spaces, and garages — according to the applicable capacity or square-footage thresholds. Extinguishers must be placed in readily accessible, clearly visible locations, and records of inspections and maintenance are typically kept to demonstrate ongoing compliance. Operators with approved automatic fire suppression systems in place should confirm whether that system satisfies the exemption under subsection (b) for the relevant areas.

Elmira Code ch. 8, art. V § 8-405 gives tenants a basis to expect properly placed and appropriately typed fire extinguishers in common areas such as boiler rooms, garages, and public spaces within their building. If extinguishers appear to be missing, inaccessible, or of the wrong type for a given area, tenants can document the condition and report it to the relevant local code enforcement or housing inspection authority in Elmira. Tenant-rights organizations can help residents understand how to raise a code-compliance concern or use a documented violation as part of a broader housing complaint.
