Elmira, N.Y., Code ch. 8, art. V § 8-521
Responsibilities of owners
Operative Text
(a) Owners and lessors of premises shall be responsible for compliance with the housing standards and this article, and shall remain responsible therefor, regardless of the fact that this article may also place certain responsibilities on operators and occupants, and regardless of any agreement between or among owners, lessors, operators and occupants as to which party shall be responsible, except as provided in subsection (b) of this section. (b) Owners and lessors of premises shall be responsible for proper maintenance, condition and operation of service facilities. Owners and lessors shall be responsible for providing adequate heat and hot water, unless otherwise provided in written agreement with occupants. (c) Owners and lessors of premises shall be responsible for independent inspections and tests of equipment and systems used in connection with such premises, and for filing and maintaining reports thereof. (d) Owners and lessors of premises shall be responsible for posting of printed statements of the maximum number of occupants permitted in designated parts of the premises. (e) Owners and lessors of premises shall be responsible for the removal of garbage, refuse and junk, to ensure that the premises are maintained in a safe, clean, healthful and sanitary condition, and shall provide adequate private carting for such removal. Any municipal collection which may be provided shall be supplemented by private carting service when necessary.
Elmira Code ch. 8, art. V § 8-521 establishes that owners and lessors of residential premises bear primary responsibility for complying with local housing standards, regardless of any private agreements that might shift that duty to operators or tenants. The rule covers a broad range of obligations, including maintaining service facilities, supplying heat and hot water, conducting independent equipment inspections, posting occupancy limits, and managing garbage removal. A written agreement with occupants can shift the heat and hot water obligation, but all other owner duties under this article remain fixed by law.
Plain English — not legal advice.
Under Elmira Code ch. 8, art. V § 8-521, compliant property owners and lessors generally keep service facilities in proper working order, ensure adequate heat and hot water are available (or document any written transfer of that duty to occupants), arrange for independent inspections and testing of building systems, post maximum occupancy notices in required areas, and maintain a private carting arrangement for garbage and refuse removal. Operators should be aware that private agreements with tenants or operators do not relieve the owner of statutory compliance obligations under this article. Maintaining thorough records of inspections, reports, and any written heat/hot-water agreements is consistent with the responsibilities outlined in § 8-521.

Elmira Code ch. 8, art. V § 8-521 makes clear that tenants have a right to occupy premises where the owner or lessor—not the tenant—bears primary responsibility for housing-standard compliance, proper maintenance of service facilities, heat and hot water supply, equipment inspections, occupancy postings, and garbage removal. If an owner attempts to use a lease clause or side agreement to avoid these obligations (other than a written heat/hot-water arrangement), that agreement does not override the owner's duties under § 8-521. Tenants who believe these standards are not being met may consider contacting Elmira's local code enforcement office, consulting a tenant-rights organization, or raising a violation of § 8-521 as a defense or basis for a complaint.
