Plain English

Section 324-4 of Fulton, N.Y., Code of Ordinances ch. 324 makes it unlawful within the City of Fulton to refuse to sell or rent housing, discriminate in terms or conditions, publish discriminatory advertisements, misrepresent availability, or engage in blockbusting based on race, color, religion, sex, handicap, familial status, or national origin. The rule applies to the full arc of a housing transaction, from initial negotiation through the provision of services and facilities. Exemptions exist under § 324-7, but outside those exemptions the prohibition is broad and covers both direct refusals and more subtle forms of differential treatment.

For Property Managers

Under § 324-4 of Fulton's Code of Ordinances ch. 324, compliant housing providers apply consistent, documented criteria when evaluating offers, negotiating terms, and communicating availability to all prospective buyers or renters regardless of protected characteristics. Marketing materials and listings are reviewed to ensure they contain no language or imagery that signals a preference, limitation, or exclusion tied to race, color, religion, sex, handicap, familial status, or national origin. Operators also avoid any practice of steering, misrepresenting availability, or making profit-motivated representations about neighborhood demographic changes, as each of those acts is independently prohibited by this section.

For Tenants

Section 324-4 of Fulton, N.Y., Code of Ordinances ch. 324 establishes that residents and prospective residents have the right to be free from discriminatory refusals, unequal terms, misleading statements about availability, and blockbusting tactics in any housing transaction within the City of Fulton. If a person believes one of these prohibited acts has occurred, general enforcement paths can include filing a complaint with a local or state fair-housing agency, raising the violation through available civil proceedings, or contacting a tenant-rights or fair-housing organization for information about options. Reviewing whether any exemption under § 324-7 applies to a particular property is also a relevant step when assessing a potential violation.
