Fulton, N.Y., Code of Ordinances ch. 475 § 475-13
General requirements
Operative Text
A. Buildings occupied in whole or in part as defined in this chapter shall comply with the requirements hereinafter set forth concerning occupancy, size, light and ventilation in order to provide a safe and healthful environment. B. The term "accessory use" shall have a uniform meaning and shall apply in the same manner and under the same conditions or restrictions to all buildings.
Section 475-13 of Fulton, N.Y., Code of Ordinances Chapter 475 establishes baseline standards that covered buildings must meet regarding occupancy limits, minimum size, lighting, and ventilation. The provision's goal is to ensure that residential and mixed-use spaces provide a safe and healthful environment for occupants. It also standardizes the definition of 'accessory use' so that the term is applied consistently and equally across all buildings subject to the chapter.
Plain English — not legal advice.
Under § 475-13, operators of buildings that fall within the scope of Chapter 475 are generally expected to maintain their properties in compliance with the chapter's occupancy, size, light, and ventilation standards. Compliant operators typically conduct periodic reviews of their units to confirm that conditions meet these baseline requirements. The uniform application of the 'accessory use' definition under this section also means that any accessory spaces on a property are subject to the same rules as comparable spaces in other covered buildings.

Section 475-13 of Fulton's Code of Ordinances establishes a right to occupy housing that meets minimum standards for occupancy, size, light, and ventilation. If a tenant believes their unit falls short of these requirements, general enforcement paths may include filing a complaint with the local code enforcement or housing office, raising the violation as a defense in relevant proceedings, or reaching out to a local tenant-rights organization for guidance. Because the provision applies uniformly to all covered buildings, tenants in any type of covered structure may be able to invoke these protections.
