Plain English

Section 475-14 of Fulton, N.Y., Code of Ordinances ch. 475 establishes minimum floor-area requirements tied to the number of people living in a space. Dwelling units must provide at least 324 square feet for one person, with additional area required for each additional occupant. Lodging units, rooming units, and group-living facilities such as dormitories and fraternity or sorority houses each follow their own distinct square-footage formulas to cap how many people may lawfully occupy a given space.

For Property Managers

Operators of rental housing in Fulton, N.Y., generally verify that each unit's gross floor area meets the per-occupant minimums set out in § 475-14 before approving a tenancy or allowing additional occupants to move in. Compliant landlords maintain records of each unit's measured floor area and apply the correct formula—whether for a dwelling unit, lodging unit, rooming unit, or group-living facility—when evaluating occupancy requests. Allowing occupancy that exceeds the limits calculated under § 475-14 can expose a property to code-enforcement action.

For Tenants

Under § 475-14 of Fulton's housing code, tenants have a right to live in a unit that meets the minimum floor-area standards for the number of occupants present. If a unit appears to be overcrowded beyond what the square-footage formulas allow, tenants may report the condition to the local code-enforcement or housing-inspection office. Tenant-rights organizations can help residents understand how the occupancy calculations under § 475-14 apply to their living situation and what complaint processes may be available.
