Fulton, N.Y., Code of Ordinances ch. 475 § 475-40
Cooking and refrigeration
Operative Text
A. General requirements. (1) Each dwelling unit shall be provided with appropriate cooking and refrigeration equipment. Cooking and refrigeration equipment shall be provided by the owner or by the tenant in accordance with their mutual, written or oral agreement. (2) Cooking and refrigeration equipment shall be maintained in good operating condition. (3) Gas-burning cooking equipment shall be permanently connected in place. Gas supply connections to such equipment shall be made with approved pipe or with an approved flexible tubing connector. (4) The combustion chambers of solid fuel-burning cooking equipment shall be appropriately vented. B. Communal cooking and dining facilities. Every communal kitchen and dining room located in a rooming house shall have adequate floor space and facilities to accommodate all of the occupants thereof at the same time and shall be so located as to be accessible to the occupants of each rooming unit, sharing the use of such facilities, without going through a dwelling unit or rooming unit of another occupant.
Section 475-40 of Fulton, N.Y.'s Code of Ordinances requires that every dwelling unit be equipped with functioning cooking and refrigeration equipment, with responsibility for providing it determined by a written or oral agreement between the owner and tenant. Gas-burning cooking appliances must be permanently installed and connected using approved piping or flexible connectors, while solid fuel-burning equipment must be properly vented. In rooming houses, shared kitchens and dining areas must be large enough to accommodate all occupants simultaneously and must be reachable without passing through another occupant's private unit.

Under § 475-40, compliant property operators ensure that every dwelling unit has working cooking and refrigeration equipment and document—whether in writing or through a clear oral understanding—which party is responsible for supplying it. Operators managing rooming houses pay particular attention to communal kitchen and dining spaces, confirming that those areas offer sufficient floor space for all occupants at once and are accessible via common areas rather than through private units. Gas appliances are permanently connected using code-approved pipe or flexible connectors, and any solid fuel-burning cooking equipment is fitted with proper venting for combustion chambers.

Section 475-40 establishes that tenants are entitled to cooking and refrigeration equipment in good operating condition, with the question of who supplies it governed by the agreement—oral or written—made with the owner. If equipment is broken or missing and the owner bears responsibility under that agreement, tenants in Fulton may have grounds to raise a violation of this provision when seeking repairs or pursuing a complaint through local code enforcement. Tenants in rooming houses can also look to § 475-40 to confirm their right to access communal kitchen and dining facilities without having to pass through another occupant's private space; a tenant-rights organization familiar with New York housing code can help clarify available options.
