Plain English

Section 475-5 of Fulton, N.Y., Code of Ordinances ch. 475 establishes that any installation, alteration, or repair work on buildings—along with the materials and equipment used—must be reasonably safe and must comply with applicable New York State law and City of Fulton ordinances. When such work meets the requirements of the New York State Uniform Fire Prevention and Building Code or the City of Fulton's own code, that compliance serves as prima facie evidence that the work is reasonably safe. The provision essentially creates a legal presumption of safety when recognized code standards are followed.

For Property Managers

Property owners and managers operating under § 475-5 of ch. 475 generally ensure that all installation, alteration, and repair projects—along with the materials, assemblies, and equipment involved—conform to both New York State law and City of Fulton requirements. Compliant operators typically document that their work meets the New York State Uniform Fire Prevention and Building Code or the City of Fulton Code, since such conformity establishes a prima facie presumption of reasonable safety. Maintaining records of permits, inspections, and code-compliant materials is a common practice that supports demonstrating adherence to this standard.

For Tenants

Under § 475-5 of Fulton, N.Y., Code of Ordinances ch. 475, tenants have an interest in knowing that any building work, materials, or equipment in their residence is required to be reasonably safe and to conform to applicable state and local codes. If work appears to fall short of these standards, tenants may have grounds to raise a code-compliance concern with the City of Fulton's relevant building or code enforcement office. Tenant-rights organizations can help residents understand what documentation or inspection records they may be entitled to review in connection with work performed on their building.
