Penalties for offenses
Operative Text
A. In addition to any and all other remedies as provided in any other applicable statute, local law, ordinance or regulation, any person, owner or occupant violating any of the provisions of this chapter shall be deemed guilty of a violation and, upon conviction thereof, shall be fined in an amount not exceeding $500 and/or shall be imprisoned in the Oswego County Jail for a period not exceeding 15 days. The City shall have the right to charge any person, owner or occupant violating any of the provisions of this chapter with the reasonable costs incurred by the City in investigating and administering complaint(s), processing the complaint(s), correspondence to necessary parties and all other reasonable administrative and actual costs. If an owner is responsible under this chapter, the City shall have the right to impose a special assessment against the subject property, by resolution of the Common Council, and/or file a civil judgment against any person and/or owner and/or occupant responsible for the violation, but the City shall not be able to collect more than the amount due.
Section 475-60 of Fulton, N.Y., Code of Ordinances Chapter 475 establishes penalties for violating the chapter's housing provisions. Any person, owner, or occupant found guilty of a violation may face a fine of up to $500 and/or up to 15 days in the Oswego County Jail, with each day a violation continues treated as a separate, ongoing offense. Beyond criminal penalties, the City may also recover its reasonable administrative and investigative costs from the responsible party, and if an owner is at fault, the City may place a special assessment on the property or file a civil judgment—though total collection is capped at the amount actually owed.
Plain English — not legal advice.
Property owners and managers operating under Fulton, N.Y., Code of Ordinances Chapter 475 generally maintain ongoing compliance to avoid the escalating consequences described in § 475-60, since each day a violation persists can be treated as a continuing offense carrying up to a $500 fine per day. Compliant operators typically respond promptly to any City correspondence about complaints, as § 475-60 also allows the City to recover its administrative and investigative costs directly from responsible owners. Owners should be aware that unresolved violations can result in a special assessment placed against the subject property or a civil judgment filed by the City.
