Geneva, N.Y., Code of Ordinances ch. 158 § 158-21
A. In any case in which a final order of the Director or of the Board directed to the City, or to any department, division, board or agency thereof, is not complied with, a copy of the order shall be transmitted to the City Manager and the Mayor, who shall take appropriate action to secure compliance therewith. B. In the event that any final order of the Director or of the Board is not complied with, the Director or the Board, as the case may be, shall notify the City Attorney, who shall petition the appropriate court to secure enforcement of or compliance with the order, or to impose penalties as set forth in this chapter, or both. The City Attorney shall certify and file with the court the final order sought to be enforced. The City Attorney shall cause a notice of the petition to be sent by certified mail to all parties or their representatives. C. If, within 60 days after the date the Board's order concerning an unfair housing practice is entered, no petition has been filed under Subsection B of this section, any person entitled to relief under the final order may petition the appropriate court for a decree enforcing the order.

Plain English

Section 158-21 of Geneva, N.Y., Code of Ordinances ch. 158 establishes a multi-track system for enforcing final orders issued by the Director or the Board. If a final order goes unheeded, the City Attorney may petition a court to compel compliance or impose penalties, or both. Additionally, if no court petition is filed within 60 days of a Board order addressing an unfair housing practice, any person entitled to relief under that order may independently petition the appropriate court to have it enforced.

For Property Managers

Property owners and managers subject to a final order under ch. 158 § 158-21 should be aware that noncompliance triggers a formal escalation process: the City Attorney is notified and may seek court enforcement, penalties, or both. Compliant operators generally respond to Director or Board orders promptly and in writing, keeping records of all steps taken to satisfy the order's requirements. Ignoring a final order can result in court proceedings initiated either by the City Attorney or, after 60 days, by the party entitled to relief.

For Tenants

Under § 158-21, tenants or other parties who have obtained a final order in their favor have a protected right to see that order enforced. If the City Attorney does not file a court petition within 60 days of a Board order concerning an unfair housing practice, the person entitled to relief may file their own petition directly with the appropriate court. Tenants navigating this process may benefit from consulting a tenant-rights organization or legal aid provider familiar with Geneva's housing ordinances to understand the available enforcement paths.
