Geneva, N.Y., Code of Ordinances ch. 158 § 158-27
Application to pending charges and complaints
Operative Text
The procedures for administration and enforcement under this chapter shall apply to charges pending which have not had a date certain set for hearing as of the effective date of the local law codified in this chapter. However, this section shall not be construed to invalidate any administrative action taken or determinations and orders made on pending charges because of the procedures provided by this chapter.
Geneva, N.Y., Code of Ordinances ch. 158 § 158-27 establishes how the chapter's administrative and enforcement procedures apply to charges that were already pending when the chapter took effect. Specifically, the new procedures govern any pending charge that had not yet been assigned a definite hearing date at that time. At the same time, the provision makes clear that any administrative actions, determinations, or orders already taken on pending charges remain valid and are not undone simply because the chapter introduced new procedures.
Plain English — not legal advice.
Under ch. 158 § 158-27, property owners or managers with charges pending at the time the local law took effect should be aware that the procedural rules of ch. 158 now govern those matters, provided no hearing date had been set. Compliant operators generally keep careful records of any notices, hearing dates, or administrative orders they have received, since prior determinations and orders remain in force regardless of the procedural transition. Staying informed about which procedural framework applies to a given pending matter is a standard part of managing compliance under this chapter.

Section 158-27 of Geneva's Code of Ordinances ch. 158 means that if a complaint or charge was pending on your behalf when this chapter became effective—and no hearing date had been scheduled—the chapter's current procedures now apply to that matter. Importantly, any administrative decisions or orders already issued in connection with pending charges are not automatically invalidated by the shift to new procedures. Tenants navigating a pending complaint may find it useful to consult a local tenant-rights organization or legal aid office to understand how the procedural framework of ch. 158 applies to their particular charge.
