Glen Cove, N.Y., Code of Ordinances ch. 168 § 168-71
Confidentiality of rental registry
Operative Text
A. The rental registry files and any list maintained by the Building Department pursuant to this chapter and any application form filed pursuant to this chapter shall be deemed confidential and shall not be subject to freedom of information laws to the extent provided by law. B. Nothing in this section shall prevent any member of the public, prospective tenant or any resident of the City of Glen Cove from inquiring as to whether a premises has been registered pursuant to this chapter or from filing a request for investigation with the Building Department to determine whether or not compliance with this article has been achieved.
Section 168-71 of Glen Cove's Code of Ordinances (ch. 168) establishes that the rental registry files, related lists, and application forms held by the Building Department are treated as confidential records and are shielded from public disclosure under freedom-of-information laws to the extent the law allows. At the same time, the provision carves out a meaningful public right: any member of the public, prospective tenant, or Glen Cove resident may ask the Building Department whether a specific property has been registered, and may submit a request for investigation into whether a property is in compliance with the chapter.
Plain English — not legal advice.
Under § 168-71, the detailed contents of the rental registry files and application forms that operators submit to the Building Department are treated as confidential, which means the general public cannot obtain those records through a routine freedom-of-information request. Compliant operators generally maintain accurate registrations knowing that, while the underlying file contents are protected, the fact of registration itself remains a matter that anyone may inquire about. Property managers should be aware that any member of the public can ask the Building Department whether their property is registered and can trigger an investigation into compliance.

Section 168-71 gives prospective tenants and current Glen Cove residents a direct avenue to verify whether a rental property has been registered with the Building Department under ch. 168, even though the detailed registry files themselves are kept confidential. If there is reason to believe a landlord has not complied with the registration requirements, anyone may file a request for investigation with the Building Department under this same provision. Tenant-rights organizations familiar with Glen Cove housing rules can help explain what options are generally available when a property is found to be out of compliance.
