Operative Text
A. Plumbing, heating, electrical, ventilating, air-conditioning, refrigerating, cooking, fire-protection and radiation-production equipment, elevators, dumbwaiters, escalators and other mechanical additions, installations or systems for the use of the building shall be installed, located and maintained so that, under normal conditions of use, such equipment and systems will not be a danger to health or welfare, a danger because of structural defects or a source of ignition or a radiation hazard and will not create excessive noise or otherwise become a nuisance. Equipment and systems include but are not limited to apparatus, devices, fixtures, piping, pipe hangers, pipe covering, wiring, fittings and materials used as part of or in connection with such installations. B. Equipment and systems subject to damage from freezing shall be adequately protected against freezing. C. Section 178-23 of Hornell's Code of Ordinances requires that all mechanical systems in a building—including plumbing, heating, electrical, ventilation, air-conditioning, refrigeration, cooking, fire-protection, and radiation-producing equipment, as well as elevators and escalators—be installed, located, and maintained so they do not endanger health or safety under normal use. The rule also covers associated components such as piping, wiring, fittings, and fixtures. Additionally, equipment vulnerable to freezing must be protected against it, and any moving parts that could pose a hazard must be guarded to prevent accidental contact.
Plain English — not legal advice.
Under § 178-23 of Hornell's Code of Ordinances, compliant property operators generally ensure that all mechanical systems and their components are properly installed and kept in good working order so they pose no health, structural, ignition, radiation, or noise hazard. Operators typically take steps to winterize any equipment susceptible to freeze damage before cold weather arrives. Guarding or shielding moving mechanical parts that could injure occupants or visitors is also a standard practice expected under this provision.

Section 178-23 of Hornell's Code of Ordinances establishes that tenants have a right to occupy a building whose mechanical systems—heating, plumbing, electrical, and others—are maintained in a safe, non-hazardous condition. If equipment appears dangerous, is producing excessive noise, lacks freeze protection, or has exposed moving parts, these conditions may constitute violations of this provision. Tenants who believe their building falls short of these standards can document the conditions, notify the appropriate local code enforcement office in Hornell, or reach out to a tenant-rights organization for general guidance on available options.
