Plain English

Section 178-3 of Hornell's Code of Ordinances defines which properties fall under Part 1 of Chapter 178's residential regulations. The rule covers a broad range of residential properties — including single-family homes, two-family homes, multi-unit dwellings, mixed-use buildings with residential occupancies, and accessory structures — as well as the land those buildings sit on. However, the rule explicitly carves out mobile homes, mobile home courts, and transient-type housing such as hotels, motels, nursing homes, and farm labor camps, which are not subject to Part 1's requirements.

For Property Managers

Property owners and managers operating residential rental units in Hornell should confirm whether their properties fall within the scope defined by § 178-3 before assuming Part 1 applies or does not apply to them. Compliant operators of one- and two-family homes, multiple dwellings, and mixed-use buildings with residential occupancies generally treat those properties as subject to Chapter 178, Part 1. Operators of mobile home parks, hotels, motels, or similar transient-use facilities should note that § 178-3(B) explicitly excludes those property types from Part 1's coverage.

For Tenants

Tenants living in standard residential housing in Hornell — including apartments in multi-unit buildings, two-family homes, or residential units within mixed-use buildings — are generally covered by the protections established under Chapter 178, Part 1, as defined in § 178-3. Tenants in hotels, motels, nursing homes, or other transient-type arrangements should be aware that § 178-3(B) excludes those settings from Part 1's scope, which may affect what protections apply to them. Tenants who are uncertain whether their housing type is covered can consult the City of Hornell's code enforcement office or a local tenant-rights organization for general guidance.
