Hornell, N.Y., Code of Ordinances ch. 178 § 178-39
Garbage and refuse
Operative Text
A. Generally. Adequate sanitary facilities and methods shall be used for the collection, storage, handling and disposal of garbage and refuse. B. Accumulations prohibited in multiple dwellings. In multiple dwellings, it shall be prohibited to store or accumulate garbage or refuse in public halls and stairways.
Section 178-39 of Hornell's Code of Ordinances establishes two related requirements for garbage and refuse management in residential settings. First, all collection, storage, handling, and disposal of garbage and refuse must use adequate sanitary facilities and methods. Second, in multiple dwellings specifically, garbage and refuse may not be stored or allowed to accumulate in public halls or stairways.
Plain English — not legal advice.
Under § 178-39, operators of multiple dwellings in Hornell are generally expected to provide proper sanitary containers and designated disposal areas so that garbage and refuse never end up sitting in shared hallways or stairwells. Compliant property managers typically establish clear collection schedules, supply sufficient receptacles, and communicate disposal procedures to residents. Keeping common areas free of refuse accumulation is a core obligation under this provision.

Section 178-39 gives residents of multiple dwellings a basis to raise concerns when garbage or refuse is allowed to accumulate in shared hallways or stairways, as that condition is expressly prohibited. Tenants who observe ongoing violations may consider reporting the situation to the City of Hornell's code enforcement office, which oversees compliance with Chapter 178. Local tenant-rights organizations can also help residents understand what options are generally available when sanitary conditions in common areas are not being maintained.
