Plain English

Section 178-70 of Hornell's Code of Ordinances places a broad set of maintenance and safety obligations squarely on lodging house operators rather than on individual tenants or guests. The rule covers everything from capping occupancy at permitted limits to keeping exits clear, maintaining plumbing and appliances, controlling pests, and disposing of garbage in a sanitary way. Walls, floors, ceilings, and required service facilities must also be kept in safe and sanitary condition, and operators are responsible for hanging and removing window screens as needed.

For Property Managers

Operators of lodging houses in Hornell should treat § 178-70 as a checklist of ongoing, non-delegable duties. Compliant operators routinely inspect all common areas and individual units to confirm occupancy stays within permitted limits, plumbing and refrigeration equipment remains functional and clean, and exits are never blocked. Pest control programs, regular garbage removal, and timely screen installation and removal are also standard practices for operators seeking to stay in compliance with this provision.

For Tenants

Under § 178-70, lodging house residents in Hornell have a basis to expect that their operator—not the tenant—bears responsibility for sanitary conditions, working plumbing and appliances, pest extermination, clear exits, and proper garbage disposal. If these conditions are not being met, tenants can document the problems and report them to the City of Hornell's code enforcement office, which oversees compliance with Chapter 178. Tenant-rights organizations in New York can also help residents understand what options are generally available when a lodging house operator is not meeting the obligations set out in this section.
