Plain English

Section 174-2 of Hudson, N.Y., Code of Ordinances ch. 174 establishes the city's commitment to fair housing by aligning local policy with both federal and state civil rights law. The provision declares that all people have the right to own, use, and occupy housing without being treated differently because of characteristics such as age, race, sex, disability, sexual orientation, gender identity, or marital status, among others. It functions as a foundational statement of values and protected classes that shapes how the city's broader fair housing rules are interpreted and applied.

For Property Managers

Under § 174-2, the City of Hudson has formally committed to fair housing principles that mirror federal and New York State protections, meaning property owners and managers operating in Hudson are expected to conduct rental, sale, and occupancy practices free from discrimination based on the listed characteristics. Compliant operators typically maintain consistent screening criteria, apply the same terms and conditions to all applicants, and train staff on the protected classes enumerated in this provision. Familiarity with § 174-2's policy statement helps operators understand the intent behind the more specific rules that follow in Chapter 174.

For Tenants

Section 174-2 declares that Hudson residents have a recognized right to access housing without discrimination on the basis of characteristics including race, disability, gender identity, sexual orientation, and several others named in the provision. If a tenant believes this policy has been violated, general enforcement paths include filing a complaint with a local or state agency, raising the violation as a defense in a housing proceeding, or reaching out to a tenant-rights or fair housing organization for guidance. Because § 174-2 aligns with both the Federal Fair Housing Act and the New York State Human Rights Law, multiple avenues for addressing potential discrimination may be available.
