Hudson, N.Y., Code of Ordinances ch. 176 § 176-12
Request for hearing
Operative Text
Any person affected by any notice of violation issued in connection with the enforcement of any provision of this chapter or of any rule or regulation adopted pursuant thereto may request and shall be granted a hearing before the Code Enforcement Officer, provided that such person shall file, in the office of the Code Enforcement Officer, a written request for such hearing, setting forth a brief statement of the grounds therefor, designating the person and his address upon whom orders may be served and setting forth the reasons why such notice of violation should be modified or withdrawn. If this request is filed within 10 days after the service of notice of violation, compliance with such notice shall not be required while the hearing is pending.
Under Hudson, N.Y., Code of Ordinances ch. 176 § 176-12, any person who receives a notice of violation related to the enforcement of Chapter 176 has the right to request a formal hearing before the Code Enforcement Officer. To trigger this right, the affected person must submit a written request to the Code Enforcement Officer's office that briefly states the grounds for the hearing, identifies a contact address for service of orders, and explains why the violation notice should be modified or withdrawn. If that written request is filed within 10 days of receiving the notice of violation, the person is not required to comply with the notice while the hearing remains pending.

Property owners and managers subject to a notice of violation under Hudson, N.Y., Code of Ordinances ch. 176 § 176-12 should be aware that the recipient of such a notice has a statutory right to contest it. Compliant operators typically track the date a notice of violation is served, since the 10-day window for filing a hearing request is significant — a timely filing suspends the compliance obligation during the pendency of the hearing. Operators generally maintain clear records of any written communications with the Code Enforcement Officer's office, including documentation of the grounds stated in any hearing request.

Section 176-12 of Hudson's Code of Ordinances gives anyone affected by a notice of violation issued under Chapter 176 the right to request a hearing before the Code Enforcement Officer. Tenants who believe a violation notice should be changed or withdrawn can submit a written request to the Code Enforcement Officer's office, making sure to include a brief explanation of their reasons and a contact address where orders can be served. Filing that request within 10 days of receiving the notice is significant because it can pause any compliance requirement while the hearing is pending; tenants seeking guidance on this process may wish to consult a local tenant-rights organization or legal aid provider.
