C. Section 258-16 of the Ithaca, N.Y., Code of Ordinances ch. 258 incorporates New York State's Real Property Law Article 6-a eviction protections into local law, with two city-specific modifications. First, rental units whose monthly rent exceeds 345% of the applicable fair market rent are exempt from these protections. Second, Ithaca defines a 'small landlord' more narrowly than the state default, limiting that designation to landlords who own no more than one rental unit anywhere in New York State.
Plain English — not legal advice.
Under § 258-16, property owners in Ithaca are generally subject to the eviction-protection requirements of Real Property Law Article 6-a unless a specific exemption applies. Operators who own more than one rental unit anywhere in New York State do not qualify as a 'small landlord' under this provision, which may affect which procedural obligations apply to them. Compliant operators typically verify whether their units fall above the 345%-of-fair-market-rent threshold and track their total unit count statewide to understand which requirements govern their properties.

Section 258-16 extends the eviction protections of New York's Real Property Law Article 6-a to Ithaca renters, meaning tenants may be able to raise violations of those protections as a defense in eviction proceedings. Tenants whose rent is at or below 345% of the applicable fair market rent, and whose landlord owns more than one unit in New York State, are more likely to fall within the scope of these local protections. Tenants seeking to understand how this provision applies to their situation can consult a local tenant-rights organization or the City of Ithaca for guidance on available complaint or enforcement pathways under Article 6-a.
