Jamestown, N.Y., Code of Ordinances ch. 215 § 215-41
Conformance required
Operative Text
A. Residential, nonresidential, commercial and industrial buildings and accessory structures, whether occupied or vacant, shall be maintained in conformity with the provisions of this chapter. B. In order to prevent the excessive growth of weeds and grass, it is hereby declared that all lots, whether residential, nonresidential, commercial or industrial, shall be maintained in conformity with the standards set out in this chapter so as to assure that the subdivision and community at large will not be adversely affected.
Section 215-41 of Jamestown's Code of Ordinances requires that all buildings and structures—residential, commercial, industrial, or otherwise, and regardless of whether they are occupied or vacant—be kept in compliance with the standards set out in Chapter 215. The provision also extends this maintenance obligation to lots of all types, specifically to prevent weeds and grass from growing excessively in ways that could negatively affect the surrounding community. The rule applies broadly, covering both built structures and the land itself.
Plain English — not legal advice.
Under § 215-41, property owners and managers in Jamestown are generally expected to keep all buildings, accessory structures, and lots in conformance with Chapter 215's maintenance standards, regardless of whether a property is currently occupied. Compliant operators typically conduct regular inspections of both structures and grounds, addressing overgrown vegetation and structural deficiencies before they rise to the level of a code violation. Maintaining records of routine upkeep can help demonstrate ongoing compliance with this chapter's requirements.

Section 215-41 establishes that the property where a tenant lives must be maintained in conformance with Chapter 215's standards, covering both the building itself and the surrounding lot. If a tenant observes conditions such as severely overgrown vegetation or a poorly maintained structure, they may have grounds to report the issue to Jamestown's code enforcement office, which oversees compliance with this chapter. Tenants can also consult a local tenant-rights organization to better understand how Chapter 215 standards may relate to their housing situation.
