Jamestown, N.Y., Code of Ordinances ch. 215 § 215-72
Responsibilities of owners and/or agents
Operative Text
A. Owners of premises shall be responsible for compliance with the Property Rehabilitation and Conservation Code standards and shall remain responsible therefor regardless of the fact that this Part 2 may also place certain responsibilities on the occupants and regardless of any agreements between owners and occupants as to which party shall assume such responsibility. B. Owners of premises shall be responsible for the proper maintenance, condition and operation of service facilities and for furnishing heat and hot-water supply in multiple dwellings.
Under Jamestown, N.Y., Code of Ordinances ch. 215 § 215-72, property owners bear ultimate responsibility for meeting Property Rehabilitation and Conservation Code standards, even when occupants share certain duties under the same code or when a private lease agreement shifts maintenance obligations to a tenant. Owners are also specifically required to keep service facilities properly maintained and operational, and to provide heat and hot water in buildings with multiple dwelling units. This rule establishes that private contractual arrangements between owners and tenants cannot relieve an owner of these baseline legal obligations.
Plain English — not legal advice.
Under § 215-72, compliant property owners in Jamestown maintain service facilities—such as plumbing, heating systems, and hot-water equipment—in proper working order regardless of what any lease agreement says about tenant responsibilities. Operators generally document routine inspections and maintenance of these systems to demonstrate ongoing compliance with the Property Rehabilitation and Conservation Code. Because § 215-72 makes clear that lease provisions shifting maintenance duties to tenants do not transfer the owner's legal responsibility, property managers typically retain direct oversight of all code-required systems in multiple dwellings.

Section 215-72 of the Jamestown Code establishes that your landlord remains legally responsible for Property Rehabilitation and Conservation Code compliance, proper maintenance of service facilities, and the provision of heat and hot water in a multiple dwelling—regardless of any lease clause that purports to make those your responsibility. If heat, hot water, or essential service facilities are not being maintained, tenants may consider documenting the conditions and contacting the appropriate Jamestown municipal code enforcement office to report a potential violation. Tenant-rights organizations familiar with New York housing law can help explain the range of options available, including raising a § 215-72 violation in relevant proceedings.
