C. No person, bank, trust company, private banker, savings bank, industrial bank, savings and loan association, credit union, investment company, mortgage company, insurance company or other financial institution or lender doing business in the City of Middletown, New York (and if incorporated, regardless of whether incorporated under the laws of the State of New York, the United States or any other jurisdiction), or any officer, agent or employee thereof to whom application is made for financial assistance for the purchase, acquisition, construction, rehabilitation, repair or maintenance of any housing accommodation or land in the City of Middletown, New York, shall: (1) Discriminate against any such applicant or applicants because of the race, creed, color, sex, disability or national origin of such applicant or applicants, nor of any member, stockholder, director, officer or employee of such applicant or applicants, nor of the prospective occupants or tenants of such housing accommodations or land, in the granting, withholding, extending or renewing or in the fixing of the rates, terms or conditions of any such financial assistance. Middletown, N.Y., Code of Ordinances ch. 296 § 296-8 prohibits a broad range of discriminatory acts in housing transactions within the city. No person, real estate professional, or financial institution may refuse to sell, rent, or lease housing, apply different terms or conditions, publish discriminatory statements, engage in steering, or deny financing based on race, creed, color, sex, disability, or national origin. The provision also bars the use of criminal background records in ways that violate the 2016 HUD Guidance, prohibits blockbusting tactics, and protects anyone who files a complaint or opposes a forbidden practice from retaliation.
Plain English — not legal advice.
Property owners and managers operating under Middletown, N.Y., Code of Ordinances ch. 296 § 296-8 generally ensure that all advertising, application forms, tenant screening criteria, and lease terms are applied uniformly regardless of an applicant's race, creed, color, sex, disability, or national origin. When using criminal background reports in tenant screening, compliant operators follow the standards set out in the 2016 HUD Guidance, a copy of which the City provides with rental permit application materials. Operators also take care that no agent, employee, or contractor acting on their behalf engages in steering, makes discriminatory representations, or retaliates against anyone who raises a fair-housing concern.

Tenants who believe a landlord, real estate agent, or lender has violated this provision may consider filing a complaint with the City of Middletown or with the U.S. Department of Housing and Urban Development, which administers the federal Fair Housing Act alongside local ordinances.
