For Property Managers

Under Mount Vernon Code § 149-28, compliant property operators ensure that any incinerator installation meets capacity requirements for the building's intended use and is connected to a properly constructed noncombustible chimney or flue fitted with a spark arrester. Flue-fed units are maintained with auxiliary fuel-burning capability to support complete combustion. Operators also keep service openings accessible and post clearly legible, durable signs near those openings warning occupants not to dispose of highly flammable substances in the incinerator.

For Tenants

Mount Vernon Code § 149-28 establishes that building incinerators must be safely constructed, properly vented, and equipped with posted warnings about flammable materials near service openings. If an incinerator in your building appears to lack required safety features—such as a spark arrester, proper chimney connection, or warning signage—this may constitute a code violation. Tenants can report potential violations to the appropriate Mount Vernon municipal code enforcement office or consult a tenant-rights organization to understand available options.
