Mount Vernon, N.Y., Code of Ordinances ch. 149 § 149-73
Within 10 days of the Commissioner of Buildings mailing the notice described herein classifying a multiple dwelling as having a chronic history of violations, the owner is required to provide the following information to the Commissioner of Buildings (which period may be extended up to 30 days by the Commissioner of Buildings in his discretion, in writing): A. A report listing of all tenants residing in the building, showing name, apartment number, and telephone number (if available). B. A report listing all security deposits collected by the owner from each tenant and identifying the financial institution in which the security deposits are held. C. A written plan, in sufficient detail for repairs and abatement of conditions giving rise to the violations. The plan must show the time periods for commencement and completion of repairs and must identify contractors engaged by the owner to perform the work described. D. Failure to provide any of the required reports shall result in additional violations being issued for noncooperation with the requirements of this section with penalties of $500 per day for each day or part thereof that the owner fails to file the report with the Building Commissioner. This fine shall be in addition to all other fines imposed.

Section 149-73 of Mount Vernon's Code of Ordinances establishes a reporting obligation that kicks in when the Commissioner of Buildings formally classifies a multiple dwelling as having a chronic history of violations. Within 10 days of that notice—extendable up to 30 days at the Commissioner's written discretion—the building owner must submit a tenant roster, a security deposit accounting, and a detailed repair plan. Failure to submit any of these required reports triggers additional violations and a separate civil penalty of $500 per day for each day the reports remain unfiled.

For Property Managers

Under § 149-73, operators of multiple dwellings that receive a chronic-violation classification from the Commissioner of Buildings are expected to act quickly: assembling a complete tenant list with names, apartment numbers, and phone numbers; documenting all security deposits and the financial institutions holding them; and preparing a repair plan detailed enough to show contractor assignments and timelines for both starting and completing work. Compliant operators submit all three components within the 10-day window—or request a written extension before that deadline passes—to avoid the $500-per-day noncooperation penalty, which stacks on top of any other fines already assessed. Keeping organized tenant and financial records on an ongoing basis makes it far easier to respond within the tight timeframe § 149-73 imposes.

For Tenants

Section 149-73 gives tenants an indirect but meaningful protection: when their building is classified as having a chronic history of violations, the law requires the owner to produce a repair plan with specific timelines and named contractors, not just a vague promise to fix things. Tenants can ask the Mount Vernon Commissioner of Buildings whether their building has received such a classification and whether the required reports have been filed, since an owner's failure to file triggers $500-per-day penalties under this section. Tenant-rights organizations familiar with Mount Vernon housing law can help residents understand how the monitoring process under § 149-73 intersects with other remedies available to them.
