N.Y.C. Admin. Code tit. 27, ch. 2 § 27-2018.1
Notice of bedbug infestation history (New York City Housing Maintenance Code)
Operative Text
a. For housing accommodations subject to this code, an owner shall furnish to each tenant signing a vacancy lease, a notice in a form promulgated or approved by the state division of housing and community renewal that sets forth the property's bedbug infestation history for the previous year regarding the premises rented by the tenant and the building in which the premises are located. b. Upon written complaint, in a form promulgated or approved by the division of housing and community renewal, by the tenant that he or she was not furnished with a copy of the notice required pursuant to subdivision a of this section, the division of housing and community renewal shall order the owner to furnish the notice. c. An owner of a multiple dwelling shall (i) provide each tenant, upon commencement of a new lease and with each renewal lease, or (ii) post, in a prominent public location within such multiple dwelling the following: 1. a copy of the most recent electronic form submitted pursuant to subdivision a of section 27-2018.2 ; and 2. a notice, in a form promulgated or approved by the department of health and mental hygiene, that provides information about the prevention, detection and removal of bedbug infestations. (Am. L.L. 2017/069, 5/10/2017, eff. 11/6/2017)
Under N.Y.C. Admin. Code §§ 27-2001 and 27-2018.1, owners of covered housing accommodations are required to give each incoming tenant a notice disclosing the building's bedbug infestation history for the prior year, covering both the specific unit and the broader building. For multiple dwellings, owners must also provide tenants with the most recent bedbug reporting form and a Department of Health and Mental Hygiene-approved informational notice about bedbug prevention, detection, and removal — either directly to each tenant at lease signing or renewal, or by posting it prominently in a common area. If an owner fails to provide the required disclosure, the New York State Division of Housing and Community Renewal has authority to order compliance upon a tenant's written complaint.
Plain English — not legal advice.
Operators of covered housing accommodations under N.Y.C. Admin. Code §§ 27-2001 and 27-2018.1 generally maintain records of bedbug infestation history and prepare the required disclosure notice — in a form approved or promulgated by the New York State Division of Housing and Community Renewal — for delivery to each incoming tenant at the time a vacancy lease is signed. For multiple dwellings, compliant operators also furnish tenants with the most recent bedbug reporting form and a Department of Health and Mental Hygiene-approved informational notice at each new or renewal lease signing, or ensure that both documents are posted in a prominent common area of the building. Keeping dated records of when and how these notices were delivered or posted supports a clear compliance trail under this provision.

Under N.Y.C. Admin. Code §§ 27-2001 and 27-2018.1, tenants signing a new lease are entitled to receive a disclosure of the unit's and building's bedbug infestation history for the prior year, along with bedbug prevention and reporting information at each new or renewal lease. If an owner fails to provide the required notice, a tenant may file a written complaint — in a form approved by the New York State Division of Housing and Community Renewal — with that agency, which can then order the owner to furnish the missing disclosure. Tenants who believe their rights under this provision have been violated may also wish to consult a tenant-rights organization familiar with New York City housing code requirements for guidance on available options.
