N.Y.C. Admin. Code tit. 27, ch. 2 § 27-2036
The owner shall cause an inspection to be made by a licensed plumber, utility company, or other qualified gas service person of each gas-fueled space heater and, in an old law tenement or in any rooming unit, of each gas appliance, at least once a year. The findings on inspection shall be recorded on forms approved by the department and shall be kept on file by the owner for a period of one year. Such inspection reports shall be submitted to the department upon request but shall not be subject to inspection by others or to subpoena, or used in or as the basis of prosecution for the existence of a defect on the date of inspection.

Under N.Y.C. Admin. Code §§ 27-2001 and 27-2036, building owners are required to arrange at least one annual inspection of gas-fueled space heaters by a licensed plumber, utility company, or other qualified gas service professional. In old law tenements and rooming units, this obligation extends to all gas appliances, not just space heaters. Inspection findings must be recorded on department-approved forms, retained for one year, and made available to the department upon request, though the records are shielded from third-party inspection, subpoena, and use as the basis for prosecution related to defects found at the time of inspection.

For Property Managers

Operators of residential buildings subject to N.Y.C. Admin. Code §§ 27-2001 and 27-2036 generally schedule annual gas appliance inspections with a licensed plumber, utility company, or qualified gas service professional before each heating season. Owners of old law tenements and rooming units ensure that all gas appliances—not only space heaters—are included in the annual inspection cycle. Compliant operators retain completed, department-approved inspection forms on file for at least one year and have those records readily accessible should the department request them.

For Tenants

N.Y.C. Admin. Code §§ 27-2001 and 27-2036 establish a right to live in a building where gas appliances are inspected at least annually by a qualified professional, with records kept on file by the owner. If a tenant has reason to believe this inspection has not been performed, they may file a complaint with the New York City Department of Housing Preservation and Development, which has authority to request inspection records from the owner. Tenant-rights organizations and legal aid services can help residents understand what remedies may be available when an owner appears to have failed to meet this annual inspection obligation.
