Newburgh, N.Y., Code of Ordinances ch. 190 § 190-116
Penalties for offenses
Operative Text
A. Any person who shall violate any of the provisions of this chapter or fail to comply therewith or who shall violate or fail to comply with any order made thereunder shall be punished by a fine of not less than $1,000 or by imprisonment for a period not exceeding 15 days, or both such fine and imprisonment. B. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects. Each day that prohibited conditions exist shall constitute a separate offense. C. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
Section 190-116 of Newburgh, N.Y., Code of Ordinances Chapter 190 establishes penalties for violations of the chapter's housing provisions. A violation can result in a fine of at least $1,000, up to 15 days of imprisonment, or both. Critically, each day that a prohibited condition continues counts as a separate offense, meaning penalties can accumulate over time, and paying a fine does not eliminate the obligation to correct the underlying problem.
Plain English — not legal advice.
Under § 190-116, property owners and managers in Newburgh face a minimum $1,000 fine per offense—and potentially imprisonment—for failing to comply with Chapter 190's requirements or any orders issued under it. Because each day a violation persists is treated as a distinct offense, compliant operators prioritize prompt correction of any cited deficiencies rather than simply absorbing a one-time penalty. Maintaining records of remediation efforts and responding quickly to any orders issued under the chapter are practices consistent with ongoing compliance.

Section 190-116 makes clear that landlords in Newburgh cannot simply pay a fine and leave prohibited conditions in place—they are legally required to correct violations, and penalties continue to accrue daily until they do. If a tenant believes conditions in their unit violate Chapter 190, they may report the issue to the City of Newburgh's code enforcement office, which has authority to issue orders and pursue penalties under this provision. Tenant-rights organizations familiar with Newburgh housing law can help residents understand what options are available for documenting and reporting ongoing violations.
