Plain English

Section 190-60 of the Newburgh Code of Ordinances requires that all exterior structural elements of residential buildings—including stairs, porches, railings, cornices, and trim—be maintained in good repair and structurally sound condition. A structure meets this standard when it is free of holes and cracks and capable of bearing the loads normally placed upon it. Railings with proper balusters must be installed wherever there is a clear risk of accident or injury, including on stairs, balconies, and accessible roofs where needed.

For Property Managers

Under § 190-60, compliant residential property operators routinely inspect exterior stairs, porches, railings, cornices, and trim for holes, cracks, or structural weakness and address deficiencies promptly. Operators ensure that balustraded railings are installed on all stairs and balconies, and on porches or accessible roofs where a fall hazard exists. Maintaining documentation of inspections and repairs can help demonstrate ongoing compliance with this provision's structural soundness standard.

For Tenants

Section 190-60 gives residents of Newburgh an expectation that the exterior stairs, porches, railings, and trim of their building will be kept structurally sound and free of hazardous defects. If these elements appear damaged, cracked, or lack required railings, tenants may report the condition to the City of Newburgh's code enforcement office, which has authority to inspect and require corrections. Tenant-rights organizations can help residents understand available options, including how a documented code violation under this provision may be relevant in other housing proceedings.
