Section 190-71 of Newburgh's Code of Ordinances requires that floors, walls, and ceilings in all residential structures be kept structurally sound, clean, and sanitary at all times. Floors must be capable of safely bearing the loads placed on them, while walls and ceilings must be free from cracks, breaks, loose plaster, and peeling or flaking paint. Additionally, any protective coatings applied must be lead-free, addressing both structural integrity and potential health hazards from deteriorating paint.
Plain English — not legal advice.
Under Newburgh Code § 190-71, compliant property operators routinely inspect floors for load-bearing integrity and keep all floor surfaces clean and sanitary. Walls and ceilings are kept free from cracks, breaks, loose plaster, and any peeling or flaking paint, with repairs made promptly when such conditions are identified. When repainting or applying protective coatings, operators use lead-free paint products to satisfy the provision's explicit material requirement.

Section 190-71 gives residents of Newburgh rental housing the right to floors, walls, and ceilings that are structurally sound, clean, and free from peeling or flaking paint and loose plaster. If conditions such as cracked walls, deteriorating ceilings, or flaking paint are present, tenants may document the issues and report them to the appropriate local code enforcement or housing authority. Tenant-rights organizations in the Newburgh area can help residents understand how a landlord's failure to meet § 190-71 standards might be raised as a defense or the basis for a formal complaint.
