For Property Managers

Under § 190-72, compliant residential property operators ensure that all bathroom, shower room, and toilet room floors are surfaced with water- or moisture-resistant materials—such as tile, sealed concrete, or similar finishes—from the outset. Ongoing maintenance practices include keeping these floors dry, clean, and sanitary, which typically means promptly addressing leaks, deteriorating grout, or damaged flooring materials. Routine inspections of these spaces help operators identify and correct conditions that could bring a property out of compliance with this provision.

For Tenants

Section 190-72 gives residents of Newburgh rental housing a basis to expect that bathroom, shower room, and toilet room floors are properly water-resistant and kept in a dry, clean, and sanitary condition. If a floor in one of these rooms is deteriorating, retaining moisture, or otherwise failing to meet this standard, tenants may document the condition and report it to the appropriate local code enforcement authority in Newburgh. Tenant-rights organizations can also help residents understand the general options available when a landlord does not address conditions covered by § 190-72.
