Section 190-8 of Newburgh's Code of Ordinances, Chapter 190, establishes that every city department, official, and employee with permit or license authority over residential construction, installation, repair, use, or occupancy must operate in accordance with the chapter's standards. No permit or license related to dwellings, dwelling units, rooming houses, or rooming units may be issued if doing so would conflict with Chapter 190, with the limited exception outlined in § 190-7. The rule functions as an internal compliance mandate, ensuring that city government itself does not authorize work or occupancy that falls outside the housing code's requirements.

For Property Managers

Under § 190-8 of Newburgh's Code of Ordinances ch. 190, compliant property operators generally ensure that any permit or license application for construction, installation, repair, use, or occupancy of a dwelling or rooming unit aligns with the full requirements of Chapter 190 before submission. Because city officials are prohibited from issuing permits that conflict with the chapter, applications that do not meet code standards will be denied at the permitting stage. Operators familiar with Chapter 190's requirements—and the exception in § 190-7—are better positioned to prepare applications that move through the city's review process without conflict.

For Tenants

Section 190-8 of Newburgh's Code of Ordinances ch. 190 means that city officials are not permitted to issue permits or licenses for residential dwellings or rooming units that would violate the housing code, giving tenants a baseline assurance that authorized work or occupancy has cleared a code-compliance check. If a tenant believes a permit was issued in conflict with Chapter 190, they may raise that concern with the relevant city department or consult a local tenant-rights organization for guidance on available options. Understanding this provision can also be relevant when evaluating whether work performed on a dwelling was properly authorized under the city's standards.
