Newburgh, N.Y., Code of Ordinances ch. 190 § 190-93
Required space in dwelling units
Operative Text
A. Gross floor area. Every dwelling unit shall contain a minimum gross floor area of at least 150 square feet for the first occupant, at least 100 square feet for each of the next two occupants and at least 75 square feet of gross floor area for each occupant thereafter. B. Ceiling height. Every habitable room shall have a minimum ceiling height of seven feet over 50% of the floor area, and the floor area where the ceiling height is less than five feet shall not be considered as part of the floor area in computing the minimum gross floor area.
Section 190-93 of Newburgh's Code of Ordinances establishes minimum space standards for dwelling units. The first occupant requires at least 150 square feet of gross floor area, each of the next two occupants requires at least 100 square feet each, and every additional occupant beyond that requires at least 75 square feet each. Habitable rooms must also have a ceiling height of at least seven feet over half of the floor area, and any portion of the floor where the ceiling is below five feet cannot be counted toward the required minimums.

Under § 190-93, compliant operators in Newburgh ensure that each dwelling unit meets the tiered gross floor area thresholds before determining occupancy limits — 150 square feet for the first occupant, 100 square feet for each of the next two, and 75 square feet for each additional occupant. When calculating available floor area, property managers exclude any portions of a room where the ceiling height falls below five feet, and they verify that at least half of each habitable room's floor area has a ceiling height of seven feet or more. Keeping accurate floor plans and ceiling-height measurements on file can help demonstrate compliance with § 190-93 during inspections.

Section 190-93 gives occupants of Newburgh dwelling units a right to a minimum amount of livable space, calculated according to a tiered formula based on the number of people in the unit, as well as minimum ceiling-height standards in habitable rooms. If a tenant believes their unit falls short of these space or ceiling-height requirements, they may raise the violation with local housing or code enforcement authorities in Newburgh. Tenant-rights organizations familiar with local housing codes can help residents understand how § 190-93 applies to their situation and what complaint or enforcement paths may be available.
