Newburgh, N.Y., Code of Ordinances ch. 240 § 240-11
Retaliatory actions
Operative Text
A. No person shall institute or maintain an action for eviction because the occupant has reported a violation of this law or any related provision of the Code to the Code Compliance Bureau or other City employee. B. No person shall cause any service, facility, equipment or utility required under this article to be removed, shut off or discontinued in retaliation for a complaint.
Newburgh, N.Y., Code of Ordinances ch. 240 § 240-11 prohibits any person from pursuing eviction proceedings or cutting off required services, facilities, equipment, or utilities against an occupant because that occupant reported a housing code violation to the Code Compliance Bureau or another City employee. The rule treats both eviction actions and service terminations as forms of illegal retaliation when they are motivated by a tenant's complaint. This protection applies regardless of whether the underlying complaint was ultimately found to be valid.
Plain English — not legal advice.
Under ch. 240 § 240-11, compliant property operators in Newburgh take care to ensure that eviction proceedings and any changes to services, utilities, or facilities are grounded in legitimate, documented reasons entirely unrelated to a tenant's housing-code complaint. Operators generally maintain clear records showing the independent basis for any adverse action taken against an occupant, so that the timing of a complaint cannot be construed as the motivating factor. Familiarity with the Code Compliance Bureau's role under this provision helps operators avoid actions that could be characterized as retaliatory.

Section 240-11 of the Newburgh Code of Ordinances gives occupants the right to report housing code violations to the Code Compliance Bureau or other City employees without facing eviction or loss of required services as a consequence. If an eviction is filed or services are cut off shortly after a complaint is made, that sequence of events may be relevant to a retaliation claim under this provision. Tenants who believe they are experiencing retaliation can document the timeline of their complaint and any adverse actions, and may consider reaching out to a local tenant-rights organization or the City of Newburgh for information about available remedies.
